Conditions / reason for refusal: Time limit for commencement 1) The development permitted shall be begun before the expiration of three years from the date of this permission. Reason - In order to comply with the provisions of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Approved Plans 2) The development hereby granted shall be carried out in accordance with the drawings hereby approved: i. Application Form dated 05 May 2017, received 08 May 2017; ii. Site Location Plan, received 08 May 2017; iii. General Arrangement (ref: 2017s5861-004) received 12 June 2017; iv. Cross Sections (ref: 2017s5861-005) received 12 June 2017; v. Long Section Down Pre-Barrage Weir (ref: 2017s5861-006) received 12 June 2017; vi. Check Weir including fish pass arrangement bypass channel (ref: 2017s5861-007) received 12 June 2017; vii. Flood Risk Assessment (ref: 7611) dated 27 April 2017, received 08 May 2017. Reason - To ensure a satisfactory development and to avoid any ambiguity as to what constitutes the permission.

Pre-occupancy or other stage conditions 3) Within 12 months of the commencement of the development hereby approved, an environmental management plan for clearance of the weir shall be submitted to an approved in writing by the Local Planning Authority. Thereafter, the development shall be undertaken in accordance with the approved scheme throughout the duration of this permission. Reason - In the interests of protecting the local environment and local amenity.

Note to Developer: 1. An Ordinary Watercourse Flood Defence Consent should be obtained from Cumbria County Council prior to the commencement of the development.
